Information on processing of personal data

Data protection is a matter of trust — and your trust is important to us. It is extremely important that as a customer, you feel safe when you shop at FB Trading. In the following information, FB Trading will explain how FB Trading uses the personal information that you leave behind by placing an order, or when you visit www.fbtrading.com, as well as when you use the various functions on the website.

Processing activities

Delivery of goods and services
When we process an order or a return from you, we process the following categories of personal information:
  • Your account ID with us
  • Your name, address, telephone number and e-mail address
  • Shipping address and invoicing address (if different from your address)
  • Order details and order history
  • Payment method
  • Return details, such as reason for return
  • Complaints
  • Any other correspondence we may have with you in connection with your orders

The legal basis for this processing is article 6(1)(b) of Regulation (EU) 2016/679 (hereafter referred to as “GDPR”), as the processing is necessary in order for us to enter into and to fulfil a contract with you, and GDPR article 6(1)(f), as the processing is necessary in order for us to pursue our legitimate interest in optimizing our business and providing good customer service.
We will retain historic transaction with you for five years from the end of the year, in which the transaction took place in accordance with our obligation pursuant to the Danish Act on bookkeeping. Other information will be retained as long as we store transactions with you, i.e. for five years from the end of the year of the latest transaction, as this is necessary for us to maintain sufficient documentation in accordance with the Danish Act on bookkeeping.
We may retain your information for longer if this is necessary in specific situations in order for us to comply with a legal obligation or to establish, exercise or defend a legal claim.
 

Subscription to the newsletter:

For the purpose of handling your subscription to our newsletter, we process the following information about you:
  • Your name and e-mail address
  • Documentation of your consent to receive newsletters, including information on withdrawal of this consent
     
The legal basis for this processing is GDPR article 6(1)(f), as the processing is necessary in order for us to pursue our legitimate interest in communicating with parties interested in receiving newsletters and other marketing material from us.
We retain your information for two years from the end of the year, where you withdrew your consent, or – if we do not use your consent actively to send you newsletters for a period of 12 months – two years from the end of the year, where we sent the latest newsletter.
We may retain your information for longer if this is necessary in specific situations in order for us to comply with a legal obligation or to establish, exercise or defend a legal claim.

Information about vendors, business partners
If you are/represent a vendor or business partner, we process the following categories of personal information about you in order for us to manage our relationship with you:
  • Your name and business contact information
  • Our trading history with you or the company you represent
  • Correspondence with you or the company you represent

The legal basis for this processing is GDPR article 6(1)(b), as the processing is necessary in order for us to enter into and to fulfil a contract with you, and GDPR article 6(1)(f), as the processing is necessary in order for us to pursue our legitimate interest in maintaining a good and effective relationship with our vendors and business partners.

While transactions are deleted five years from the end of the year, in which the transaction took place, other information is retained throughout our relationship and for five years from the end of the year, where we were in contact with you last time.
We may retain your information for longer if this is necessary in specific situations in order for us to comply with a legal obligation or to establish, exercise or defend a legal claim.

Other external persons
If you contact us for any reason, other than as a customer, vendor, business partner or recipient of newsletter, we will process the following information about you for the purpose of processing your request:
  • Your name and contact details, including address, e-mail address and telephone number
  • Details of your request or reason to contact us, as well as any correspondence with you

The legal basis for this processing is GDPR article 6(1)(f), as the processing is necessary in order for us to pursue our legitimate interest in communicating effectively with stakeholders and others showing interest in our company.
We will retain your information for two years from the end of the year, we were last in contact with you.
We may retain your information for longer if this is necessary in specific situations in order for us to comply with a legal obligation or to establish, exercise or defend a legal claim.

Visitors to website
If you visit our website, we may collect the following categories of personal information about you:
  • Information about your IP address
  • Information about the device you use to access our website, including EMEI number and technical details about device type and operating system
  • Information about your use of our website, including what links you click on, how you move around on the site, how long you stay on the site and other types of information about your use of the site
  • Information about your preferences, such as language and cookie preferences
The information is collected through the use of cookies and similar technologies. The cookies we use on our website are used for different purposes, and the retention period for the information depends on the individual cookies. Please refer to our cookie policy for further information.
The legal basis for this processing of personal data is GDPR article 6(1)(f), as the processing is necessary in order for us to pursue our legitimate interest in providing a well-functioning website which is optimized based on users’ interests and preferences.
We may retain your information for longer if this is necessary in specific situations in order for us to comply with a legal obligation or to establish, exercise or defend a legal claim.

Disclosure of data to third parties
Personal information is only passed on to third parties outside FB Trading if it is necessary to be able to fulfill our obligations to you as a customer. Information may be shared with third parties in connection with:
  • Customer service, order processing and marketing: Information is shared with employees of HTJ Aarhus in connection with customer service, order processing and marketing of FB Trading.
  • Shipping: Name and address information is passed on to shipping agents in connection with their delivery of your goods.
  • Troubleshooting and development: Information can be shared with an external programmer in connection with troubleshooting and website development.


Further to this, your personal data may be accessible for service providers supporting our business in a role as data processors, such as providers of hosting services or other IT services. All data processors undertake to abide by FB Trading’s data processing agreement.



Export of personal data to countries outside the EEA
Unless it is strictly necessary to fulfil a request from you, FB Trading does not transfer or make your personal information available to third parties in countries outside the EEA.

This will only be the case if you are located outside the EEA, or you are asking us to deliver goods or services to an address outside the EEA.

In such situations, the transfer will be based on GDPR article 49, section 1, point (a), (b), (c) or (e).
 

Your rights
Pursuant to GDPR, you have the following rights:
  • You may request access to and correction or deletion of the personal information we have collected.
  • You may oppose to the processing of personal data or request restriction of the processing of your personal data
  • In particular, you have a right to oppose to the use of your personal data for direct marketing purposes
  • If the processing of your personal data is based on your consent, you have the right to withdraw this consent at any time. Please be aware that withdrawal of consent will only affect future processing and will not affect the lawfulness of the processing carried out prior to your withdrawal of consent
  • You may request to receive your data in a structured, commonly used and machine-readable format (data portability).
     
You can exercise your rights by contacting us at info@fbtrading.com. However, please be aware that the exercise of your rights may be subject to conditions or restrictions. Therefore, depending on the specific circumstances, you may not be able to exercise certain rights.
You can, however, always file a complaint with your local data protection authority.
